THE ATCO CHALLENGE: Celebrating Excellence
Alberta students in Grades 4 through 12 are invited to submit a compositionin their own words on how they pursue leadership and strive for excellencein sports, arts, culture, education or community involvement.
Two students (one male and one female) from each of Alberta’s 83 constituencieswill be randomly drawn and rewarded with a trip of a lifetime to Vancouver!
OFFICIAL ATCO CHALLENGE RULES ATCO'S Celebrating Excellence Challenge (the “ATCO Challenge”)
ATCO Ltd. (the "ATCO") is delighted to offer this opportunity to Grade 4 through 12students in Alberta. No purchase is necessary. Limit one (1) entry per personduring the ATCO Challenge Period, regardless of method of entry.
To be eligible to be entered in the random draw, you must submit your compositionduring the ATCO Challenge Period and comply with all of these Official ATCO Challenge Rules.All compositions submitted in the ATCO Challenge shall become the property ofATCO and will not be returned or acknowledged. ATCO wishes to acknowledge the generous contributions of Winsport Canada, the Government of Alberta, (the “Sponsors) the Calgary Herald (a Print Partner) and CTV Television Inc (CTV)(a Broadcast Partner); without whom this ATCO Challenge would not be possible.
1. How to participate:Participants are encouraged to use the online submission form available on the ATCO Challenge website at (www.atco.com).
To enter electronically, use the online submission form and complete all required fields, including but not limited to, student’s first and last name, date of birth, gender, address, city/town, postal code, telephone number, grade, school, email address and if under the age of 18, confirmation of the student’s parent’s or legal guardian’s permission for the student to participate in the ATCO Challenge. After providing the required information, please type or paste your composition (see Section 2 for requirements), accept the terms and conditions of the ATCO Challenge and click the “Submit” button. Upon successful receipt of same by ATCO, you will automatically be entered in the ATCO Challenge.
To enter by mail, send your composition (see Section 2 for requirements) to The ATCO Challenge: Celebrating Excellence, c/o ATCO Ltd., 800, 909 – 11 Avenue S.W. Calgary, Alberta T2R 1N6. On a blank white piece of paper, include your first and last name, date of birth, gender, address, city/town, postal code, telephone number, grade, school, email address (optional) and if you are under the age of 18, a parent’s or legal guardian’s signature confirming their permission for you to participate in the ATCO Challenge. Compositions must be typed or clearly handwritten.
All electronic submissions must be received by ATCO via the online submission form on or before 11:59 pm, MST Tuesday, January 5, 2010. All mail-in submissions must be postmarked by January 5, 2010 and received by January 12, 2010 at 5:00 p.m. MST.
Only one entry per individual is permitted. Participation in the ATCO Challenge constitutes the entrant’s full and unconditional agreement to and acceptance of these Official ATCO Challenge Rules.
Note: All submissions must include your complete address and postal code; students will be separated into their constituency as per their postal code. Failure to provide all required information will result in your submission not being eligible for the draw.
2. Composition requirements:Each eligible composition shall describe, in 150 – 650 words, how the applicant is demonstrating leadership and striving for excellence in sports, arts, culture, education or within their community. For example by: playing or coaching a sporting activity such a swimming or snowboarding; being involved in the arts as a painter, actor or dancer; teaching English as a second language; volunteering at a seniors’ home; being involved in an organization such as Junior Achievement, 4H, Girl Guides of Canada, etc. Although eligible entries will be randomly drawn (see Section 3) and not judged on the content of the composition, each composition must be factual and relevant to the above theme and be between 150 – 650 words to qualify. Repetition of sentences or phrases is not allowed. All compositions must be original and written in English or French to be considered valid for this ATCO Challenge. Compositions that do not comply with these requirements will be disqualified and such entries will not be entered in the random draw.Some compositions may be published in connection with the ATCO Challenge and for other promotional purposes (see Section 3), so compositions should be interesting, creative, humorous, inspirational or heartwarming. By submitting a composition, you are granting ATCO the right to publish your composition, or any part thereof in any media (including online), in its original or an edited format, for promotional purposes and you are waiving any moral or other similar rights that you may have in same.
You may not submit as part of any composition any material that contains another person’s confidential or private information or copyrighted or other materials. Each composition must be an original work, created by the entrant.
3. How to win:The ATCO Challenge starts at 12:01 a.m. MST on Tuesday, November 17, 2009 and continues until 11:59 p.m. MST, Tuesday, January 5, 2010, (the “ATCO Challenge Period”). The ATCO Challenge time clock, located in the offices of ATCO Ltd., 800, 909 – 11 Avenue S.W. Calgary, Alberta T2R 1N6, is the official clock for this ATCO Challenge.
Students’ constituency as per their postal code will separate all submissions.
Leadership Rewards & Second Rewards:Random draws for the Leadership Reward (described below) will begin on Wednesday, January 13, 2010 from all eligible submissions from each of the 83 constituencies in the Province of Alberta (a total of 166 students will be awarded a Leadership Reward, one male and one female from each constituency).
The first randomly drawn male and first randomly drawn female from the first constituency (#1) will each be awarded a Leadership Reward providing they have met with the established criteria as outlined in these Official ATCO Challenge Rules. The Secondary Reward will be awarded to the first eligible student entry randomly drawn after declaring the male and female Leadership Reward recipients in that constituency. This order will continue until a male and female Leadership Reward recipient and a Second Reward recipient has been declared in all constituencies.
Each selected reward recipient will be contacted by telephone or email based on the information provided with their entry. If any selected reward recipient cannot be reached within fourteen (14) days, declines the Leadership Reward or Second Reward, indicates at the time of selection that he/she is unavailable to participate according to his/her ability to travel, fails to return a Consent and Release form as specified below, or there is a return of any prior notification as undeliverable, then that selected reward recipient will be disqualified and ATCO reserves the right, in its sole and absolute discretion, to select an alternate entrant to be eligible for such reward in accordance with these Official ATCO Challenge Rules from among the remaining eligible entries.
To receive a reward, entrants who are selected to receive same must correctly answer a mathematical, skill-testing question.
Additional RewardsStarting Thursday, November 19, 2009 and daily through Tuesday, January 5, 2010, a selection of compositions will be published on www.atco.com. If a composition is published, the entrant will receive a souvenir memento.
Entrants whose compositions are published and receive a souvenir memento are still eligible to participate in the draw for the Leadership Reward and Second Reward.
4. Rewards:Leadership Reward:• There is one (1) Leadership Reward for a male student and one (1) Leadership Reward for a female student available to be won in each of the 83 ridings in the Province of Alberta (for a total of 166). Each Leadership Reward consists of a one (1) day trip for the student and their parent, legal guardian, or parent or legal guardian approved adult chaperone to Vancouver, British Columbia (the "Leadership Reward").
• Particulars of each Leadership Reward trip include:o Return airfare for two from either Edmonton or Calgary (departure city determined by constituency) including all fees and taxes.o A meal upon departure and return will be provided on the flight.o A pair of tickets to a sporting evento A pair of tickets to a celebration ceremonyo Ground transportation to each venue to be visited in Vancouvero Food and beverages at Alberta House in Vancouvero One hundred dollars cash (total) to be used at the discretion of each student and their parent or legal guardiano Souvenir Package o One night’s accommodations (optional) upon return to your departure city (room and taxes only)
• Approximate retail value of each Leadership Reward is $3,000.00 CAD (the actual value of each reward may vary and any difference between the stated value and actual value will not be awarded). ATCO reserves the right to substitute a reward or a reward component with one of equal or greater value, including, without limitation, a cash reward, for any reason whatsoever.
Note: Leadership Reward recipients will be assigned one of five pre-determined days departing from Calgary on (February 14, 15 & 16, 2010) or departing from Edmonton (February 18 & 19, 2010) to travel to Vancouver (subject to change). Each day will be approximately 15 hours long. You must be able to travel on your assigned day to receive the Leadership Reward.
Costs of additional meals, gratuities, taxes, transportation to and from their residence to the designated International Airport (Edmonton or Calgary) and all other expenses not specified as part of Leadership Reward, are the sole responsibility of reward recipient. All students and their guest must travel together unless otherwise authorized by ATCO.
Travel must be roundtrip. ATCO will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight, event, venue or other aspect of the Leadership Reward. Use of the Leadership Reward, including use of tickets, travel and attendance at various venues is subject to the terms and conditions set forth in these Official ATCO Challenge Rules, applicable to such tickets, travel or venue and, for greater certainty, includes those set forth by ATCO's airline carrier of choice, as detailed in the passenger ticket contract, and all applicable laws. Second Reward:There is one (1) second reward available to be won in each of the 83 ridings in the Province of Alberta, consisting of one (1) Acer Aspire® 1410 Portable Notebook with Intel Processor (11.6") laptop (the "Second Reward'). Approximate retail value of the Second Reward is $499.00 CAD.
Additional RewardsSouvenir mementos are available to be won each day starting Thursday, November 19, 2009 – Tuesday, January 5, 2010. Approximate retail value of the souvenir memento is $10.00 CAD. All rewards must be accepted as awarded and may not be sold or transferred and are not convertible to cash. No substitutions except at ATCO's option. Any reward that is not accepted as awarded will be forfeited and the entrant will not receive any other compensation in lieu of the reward.
Neither ATCO nor any of our Sponsors nor the Calgary Herald or CTV warrant any of the products, materials or services that a reward recipient receives. The materials, services or products that a reward recipient receives are provided “as is”, "where is" and "with all faults". There may be warranties provided by the manufacturer of the product, material or service, for which ATCO, our Sponsors and CTV have no responsibility or duty to perform.
5. Eligibility:The ATCO Challenge is only open to permanent residents of Alberta who are, on the date of the draw for the applicable reward, enrolled in a provincially approved school in Alberta and in Grades 4, 5, 6, 7, 8, 9, 10, 11 or 12. Immediate family members (son or daughter, brother or sister) or persons living in the same household as an employee of ATCO Ltd, Canadian Utilities Limited or our Affiliates, Sponsors or the Calgary Herald or CTV are not eligible to enter the ATCO Challenge. The ATCO Challenge is subject to all applicable federal, provincial and municipal laws and regulations.
If an entrant is under the age of majority, upon online submission, each entrant will be prompted to check a box indicating they have permission from their parent or legal guardian to enter the ATCO Challenge. If submitting by mail, entrants must have written permission from their parent or legal guardian to enter the ATCO Challenge.
6. Odds of Winning/Skill-Testing Question/Winner Declaration:Odds of winning depend on the number of eligible entries received. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy the eligibility and other requirements setout herein may be disqualified and will not be eligible to participate in the draw.
By submitting a composition and entering the ATCO Challenge, entrants release and hold harmless ATCO Ltd, Canadian Utilities Limited or our Affiliates, Sponsors or the Calgary Herald or CTV and their respective advertising and promotional agencies and the ATCO Challenge judges, their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the “Releasees”) from any liability in connection with this ATCO Challenge or, if declared a winner, the rewards.
BEFORE BEING DECLARED A WINNER, each selected entrant (or his/her parent/legal guardian in the case of a minor) will be required to sign and return a standard declaration and release form: (i) confirming compliance with these Official ATCO Challenge Rules, (ii) confirming acceptance of the reward as awarded, and willingness to conform to such rules and regulations governing participation (iii) releasing the Releasees from any liability in connection with this ATCO Challenge, the entrant's participation therein and/or the awarding and use of the reward or any portion thereof; (iv) consenting to the use of his/her name, city or town and/or photograph, without further notice or compensation, in any publicity or advertisement carried out by ATCO, Sponsors or the Calgary Herald or CTV, or their respective affiliates or assigns or its affiliates in any manner whatsoever, including print, broadcast or the Internet, and (v) correctly answering, unaided, the mathematical skill-testing question appearing on the declaration and release form.
If a selected entrant fails to sign and return any required document or fails to correctly answer, unaided, the mathematical skill-testing question appearing on the declaration and release form, within 72 hours of delivery of same to the address setout in entry, then ATCO reserves the right, in its sole and absolute discretion, to void that entry and select another eligible entrant from among the remaining eligible entries.
7. Decisions Final/Property of ATCO:By submitting a composition and entering the ATCO Challenge, each entrant (or his/her parent/legal guardian in the case of an applicant under the age of 18 on date of entry) agrees to abide by these Official ATCO Challenge Rules. This ATCO Challenge is subject to all applicable federal, provincial and municipal laws. Void where prohibited by law. The decisions of ATCO with respect to all aspects of this ATCO Challenge are final and binding on all entrants without right of appeal.
Entrants acknowledge that ATCO Ltd, Canadian Utilities Limited or our Affiliates, Sponsors or the Calgary Herald or CTV will not be held responsible for: i) late, lost, delayed, damaged, misdirected or incomplete entries; ii) the failure to receive entries due to transmission failures or technical failures of any kind; or iii) any human or computer-generated error in compiling the entrants' names or awarding of the rewards.
ATCO Ltd, Canadian Utilities Limited or our Affiliates, Sponsors or the Calgary Herald or CTV are not responsible for any errors or omissions in printing or advertising in respect of this ATCO Challenge. All entries become the property of ATCO and will not be returned.
ATCO Ltd, Canadian Utilities Limited or our Affiliates, Sponsors or the Calgary Herald or CTV assume no responsibility or liability resulting from any attempts to participate in this ATCO Challenge or, if required, download any information necessary to participate in this ATCO Challenge.
No correspondence will be entered into except with the selected entrants.
8. Website Problems and Disputes:ATCO Ltd, Canadian Utilities Limited or our Affiliates, Sponsors or the Calgary Herald or CTV assume no responsibility for failure of the internet during the ATCO Challenge Period, or any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the ATCO Challenge. ATCO reserves the right to cancel or suspend the online portion of this ATCO Challenge should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the ATCO Challenge. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, ATCO the Sponsors, the Calgary Herald and CTV reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
In the event of a dispute regarding the identity of the person entering the ATCO Challenge electronically, the entry will be deemed to be submitted by the student in whose name the composition has been entered, provided that person meets all eligibility criteria of this ATCO Challenge.
9. Privacy:By entering the ATCO Challenge, you are consenting to the collection, use and disclosure of your personal information for the purposes of entering the ATCO Challenge, participating in the ATCO Challenge, including receiving any reward should you win, enabling ATCO to operate the ATCO Challenge and permitting ATCO Ltd, Canadian Utilities Limited or our Affiliates, Sponsors or the Calgary Herald or CTV to advertise and promote the ATCO Challenge and undertake promotional activities in connection therewith. 10. Modifying or Canceling the ATCO Challenge:If, for any reason, any portion of this ATCO Challenge is not capable of being undertaken as planned or if the administration, security, fairness, integrity, or proper conduct of this ATCO Challenge is corrupted or adversely affected, including without limitation by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, ATCO reserves the right to cancel, terminate, modify (including extending the ATCO Challenge Period) or suspend the ATCO Challenge without individual notice. Any such notice will be posted on ATCO's website at www.atco.com
NOTICES TO TEACHERS OR GROUP LEADERS:We would like to encourage as many youths as possible to take part in the ATCO Challenge: Celebrating Excellence. Please read through these Official ATCO Challenge Rules and, in particular, the eligibility criteria, with your students and submit their composition (between 150 and 650 words). Individual entries may be mailed together to save on postage.
