To the maximum extent permitted by law, all implied terms are excluded from this Agreement and ATCO will not be liable for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defence or settlement costs) whatsoever, whether direct, special, indirect, incidental or consequential, arising out of or in connection with the use or inability to use the ATCO website including as a result of a breach of this Agreement, the supply of a defective program, or any use or reliance on any information contained on the ATCO website (including an error, omission or misrepresentation) however arising, including without limitation any lost data, lost business profits, business interruption, personal injury or any other pecuniary loss, whether in an action on contract, negligence or otherwise.
ATCO’s liability for breach of a condition or warranty implied by law which cannot be excluded is limited to the maximum extent possible, at ATCO’s option, to the supply of the goods or services again, the repair of the goods or services, or the payment of the cost of having the goods or services supplied again or repaired.

Notwithstanding the foregoing, either party may apply to any court of competent jurisdiction to obtain injunctive relief. ATCO’s Australian corporate headquarters are in Perth, Western Australia.
ATCO makes no representation that access to the ATCO website or that the information contained thereon is appropriate or legal in all jurisdictions. You may not access the ATCO website or use any information in those jurisdictions where it would be illegal.
